Netgear Terms and Conditions


What the terms cover. These are the terms and conditions on which Netgear Ltd supply you.

Why you should read them. Please read these terms carefully before you communicate or trade with us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information.

How we will accept your order. Our acceptance of your order will take place when you place an order and we accept it, at which point a contract will come into existence between you and us.

If we cannot accept your order. If we are unable to accept your order, we will inform you of this, by email or phone or in person and will refund you for the product if you have paid for it.

Accuracy, completeness and timeliness of information We are not responsible if information made available on our website, price tickets, quotations, information in person or on the telephone is not accurate, complete or current. All marketing and sales information is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material is at your own risk. We reserve the right to modify any content at any time. You agree that it is your responsibility to monitor any changes. Your product may vary slightly from those images or information or specifications given.


Providing the products

Delivery costs. The costs of delivery will be confirmed to you during the order process.

When we will provide the products. During the order process we will let you know when and how we will provide the products to you.

Delivery Times: All delivery times are estimates only. We will not provide any guaranteed delivery times. 

We are not responsible for delays. If our supply of the products is delayed for any reason  then we will contact you where possible to let you know and we will take steps to minimise the effect of the delay. We will not be liable for the delays caused.

Collection by you. If you have asked to collect the products from our premises, we will inform you of when and how you can collect them from us.

When you become responsible for the goods. You will be responsible for your goods from the time we deliver it to the address you gave us or you collect it from us.

When you own goods. Title to the goods shall not pass to you until we receive payment in full for the goods that we have supplied to you in respect of which payment has become due. Until title has passed to you, you shall hold the goods on a fiduciary basis and take all reasonable steps to store the goods safely and in satisfactory condition. 

We may suspend the supply of goods. We will contact you in advance to tell you we intend to suspend the supply of the product, unless the problem is urgent or an emergency. You may contact us to end the contract for a product if we suspend it, and we will refund any sums you have paid in advance for the product in respect of the period after you end the contract.

We may also suspend supply of the products if you do not pay. If you do not pay us for the products when you are supposed to, we may suspend supply of the products until you have paid us the outstanding amounts.



Price and payment

Where to find the price for the product. The price of the product will be the price indicated on the quotation or invoice or on the order pages when you placed your order. We take all reasonable care to ensure that the price of the product advised to you is correct. However please see paragraph below for what happens if we discover an error in the price of the product you order.

What happens if we got the price wrong? It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will check prices before accepting your order so that, where the product's correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product's correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any goods provided to you.

How you must pay. We accept payment by credit or debit card, cash, bank transfer.

We can charge interest if you pay late. If you do not make any payment to us by the due date we may charge interest to you on the overdue amount at the rate of 8% a year above the base lending rate of the Bank of England from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us interest together with any overdue amount.

What to do if you think an invoice is wrong. If you think an invoice is wrong please contact us promptly to let us know. You will not have to pay any interest until the dispute is resolved. Once the dispute is resolved we will charge you interest on correctly invoiced sums from the original due date.


Conditions of Returns:


  • Returns will be accepted upto 5 calendar days from date of purchase
  • To obtain a full refund you must not start using the device, install and/or input any data/software.
  • The goods must be in an ‘as new’ condition and returned in the original, undamaged & complete packaging, along with any accessories and/or free gifts received with them.
  • All Apple Products, Memory cards, USB sticks, Headphones & Earphones, Hard drives/SSD and software packages must still be returned sealed.
  • Goods must be returned with the original receipt or invoice as proof of purchase.
  • Special order items will not be refunded. 
  • Refunds will be done back by the same method payment originally paid with. 

Faulty goods

  • All goods are sold with a limited manufacturer’s warranty.

    • Netgear will test the product within 2 working days. 
      • Once tested by Netgear, we will open a case with the manufacturer and if the manufacturer opens a warranty case this does not mean they have accepted the device under warranty. They may decline warranty cover once they have received the item if it is not a fault covered under warranty. 
      • If the device is sent to the manufacturer and it is not a fault covered under the manufacturer's warranty there will be a £50 charge for transportation and administration for sending the device.
      • If after testing Netgear finds it is not a warranty fault, the cost of the service will be charged for.
    • The following circumstances are expressly excluded from any warranty cover: 1. Physical damage 2. Liquid Damage, 3. Software 4. Manipulation. 5. Usage beyond the manufacturer's recommendation. 
    • Warranty periods: 
      • 6 months: Consumables, batteries, cables, 
      • 2 years: TVs
      • 1 year: all other products
    • You may lose all data and there is no way of recovering it. 
  • First 14 days: We will offer either a repair, exchange or refund if the fault occurs within the first 14 days of purchase, thereafter as above.


  • Limitation of Liability


    • Our total liability will not, in any circumstances, exceed the total amount of the Price payable by you for:
      • where the claim relates to the Products supplied under the Contract, 100% of the total price of those Products;

      • where the claim relates to the Services supplied under the Contract, 100% of the total charges for those Services during the last 12 months


    • We will not be liable (whether caused by our employees, agents or otherwise) in connection with the goods, for:
      • any indirect, special or consequential loss, damage, costs, or expenses; and/or   
      • any loss of profits; loss of anticipated profits; loss of business; loss of data; loss of reputation or goodwill; business interruption; or,
      • other third party claims; and/or
      • any failure to perform any of our obligations if such delay or failure is clue to any cause beyond our reasonable control; and/or
      • any losses caused directly or indirectly by any failure or breach by you in relation to your obligations; and/or
      • any loss relating to the choice of the Goods and how they will meet your purpose or the use by you of the Goods supplied.


    Termination of contract 

    • We may end the contract if you break it. We may end the contract for a product at any time if
      •  you do not make any payment to us when it is due;
      • you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products;
      • you do not, within a reasonable time, allow us to deliver the products to you or collect them from us.

     

    • If you want to end the contract for supply of Product
      • If you end the contract for any reason after receiving the products you must return them to us. You must return the goods in person to any of our Main Trading Locations or allow us to collect them from you.  You are responsible for the cost of returning them or we will charge for collection. 
      • If you are entitled to a refund under these terms we will refund you the price you paid for the products, by the method you used for payment. However, we may make deductions from the price, as described below.
        • If you are exercising your right to change your mind: We may reduce your refund of the price to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop or if the goods are damaged in transit from you to us. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way and/or they have been damaged in transit, you must pay us an appropriate amount.
        • We will make any refunds due to you within 14 days from the day on which we receive the product back from you.

     

    • If you want to end the contract for supply of Service

      • Refer to Service contract for any minimum term and terms of Termination.

     

       

      Data protection policy


      • All personal data (name,address,email,telephone number) regarding a transaction will be stored in our cloud servers permanently because of warranty, purchasing and customer history.

      • All personal data (including sensitive data) stored as a result of a customer's device backup, upgrade or transfer maybe kept for a maximum of 30 days and deleted permanently after.

      • All personal data regarding Bank accounts, Direct debit, standing orders, payslips, ID/passports and other bills required for Finance purchase agreements between Netgear LTD and a customer, will be kept in our database for the duration of the contract. Typically 12 months.

      • Customer data will be stored until expiry and/or after you (customer) ask to not be in our registry. 

       

        Jurisdiction

        • This agreement is made in Gibraltar and falls under the jurisdiction of the Courts of Gibraltar for any disagreement on the content or application of this contract. 
        • Both parties hereby formally agree to be subject to the terms of this agreement.
